I and my family members understand that my dog’s participation in the training offered by The Fittest Dog Inc. (the ‘Company’) includes elements of risk for trainers, third-parties, attending family members/guests and my dog, which includes, without limitation, risk of illness, falls, bites and injuries, disease or death through contact with people or other dogs who may or may not be participants in training, or interior/exterior surroundings of any facility or public place where training takes place (‘Training Risks’). I and my family members acknowledge that the above list is not inclusive of all possible risks associated with my dog’s participation in training by the Company and that the above list in no way limits the extent of this waiver and release.
I and my family members assume any and all responsibility for these Training Risks. I and my family members will not hold the Company, any of the Company’s trainers, associates, employees, or affiliates responsible for any injuries or death to me, my dog, or third parties, caused wholly or in part by my dog while my dog is enrolled in training by the Company.
I and my family members, for themselves and on behalf of their respective heirs, assigns or successors, hereby expressly waive, release and discharge the Company and all of the Company’s trainers, associates, and employees, from all claims, demands, injuries, damages or causes of action that are in any way related to my dog’s participation in training by the Company,
Further, I and my family members expressly agree to defend, indemnify and hold harmless the Company and all of the Company’s trainers, associates, and employees, from and against any and all claims, demands, injuries, damages or causes of action that may be made by anyone against the Company and all of the Company’s, trainers, associates, and employees, related to my dog’s participation in training by the Company.
I and my family members expressly agree that the foregoing Assumption of Liability, Waiver and Release are intended to be as expansive, broad and inclusive as permitted by California law.
I and my family members also understand that in enrolling my dog in any of the Company’s programs, that the Company has relied upon my representation that my dog is in good health and has received the necessary vaccinations (or equivalent alternatives) as agreed upon by my veterinarian. If my dog becomes injured or ill, the Company shall have the right to call my veterinarian as designated on the Dog Information provided during the subscription setup. In the event of an emergency and my designated veterinarian is unavailable, the Company has the right to take my dog to the nearest animal hospital for immediate care. I agree to reimburse, in full, the Company for any medical expenses accrued while under the supervision of the Company. The Company will not be held responsible for any decisions made by the veterinarian on the dog’s behalf.
Some programs are not appropriate for all dogs. The Company reserves the right to remove or refuse a dog from any of the Company’s programs.
The Company makes no representations, guarantees, promises, implied or expressed, that any training provided by the Company will cure a dog of any dangerous propensities. It is fully understood that regardless of the training received by the animal, any dog is always capable of biting.
I hereby give my consent to the Company to use photographs of my dog and/or me for promotional purposes without liability or obligation to me.
I agree to all the terms of this Assumption of Liability, Waiver and Release and that the information I have provided in the dog information sections of the customer portal are correct.
